The Business Referral Program (the "Referral Program" or the "Program") is offered by Built Technologies, Inc. ("Built"). The Program offers the ability to refer your friends, colleagues and associates to Built and receive incentives. You do not have to be a Built customer to participate in the Referral Program.
Built reserves the right at any time to modify, suspend or cancel the Referral Program or the Rules and may do so at any time. Any changes made by Built will be effective immediately on notice, which it may give either by posting on the Referral Website or via e-mail. Your continued participation after such notice will be deemed acceptance of such changes to the Referral Program. Periodic review of these Rules is recommended to ensure familiarity with the most current version. Checking the "Last Revised" date at the top of these Rules will inform you of when the current version received its most recent update. All questions or disputes regarding the Referral Program, including without limitation, those involving eligibility, participation, fraud and abuse will be resolved by Built in accordance with these Program Rules.
NextBee will award a cash credit or agreed incentive (for current Built customers) (the "Reward") to any Referrer deemed Eligible (as defined below) who refers a New Customer deemed Eligible (as defined below) in accordance with these Referral Program Rules (the "Rules"). The Reward will be issued to the Eligible Referrer following 30 Days after which Built and the New Customer executes a definitive agreement for Services. A valid and complete W-9 tax form or W8-BEN form must be completed by the Eligible Referrer and collected to NextBee within thirty (30) days of a referral becoming eligible for payment or the Reward shall be forfeited. The Program is valid only in the United States, Canada, or Australia, and cannot be combined with any other offers. Built reserves the right to add, modify and/or delete any Rewards and/or requirements to receive any Rewards by updating the Rules. Any modifications to these Rules will not apply to referrals made prior to the modifications.
To qualify as an "Referrer Deemed Eligible" you must be 18 years of age or older and: (a) a legal resident of the United States territory or District of Columbia, including Puerto Rico, Canada, or Australia ; or (b) for Built customers, your existing account(s) must be in good standing at the time of the referral.
Existing and former Built customers are prohibited from referring themselves. Business owners, employees or agents are prohibited from referring their respective business(es) or employer(s) (or any affiliates thereof) and are ineligible to receive a Reward. Notwithstanding the foregoing, consultants, contractors and others who are not "employees" are deemed eligible should they refer companies for which they are contracted to work. Built reserves the right to validate that the referrer is/was not an employee at the time of referral. Referrers cannot refer immediate family members living within the same household.
By participating in the Referral Program, you agree, affirm, and represent that you have read and understand these Rules. In addition, you affirm and represent that you have complied with all the Rules.
An "Eligible New Customer" is an individual or business that (1) is not now, nor has ever previously been, a Built customer; (2) is not already registered as a Built Business lead or contact in Built’s business records; (3) fully executes a definitive agreement with Built for Services; and (4) is in good standing for at least thirty (30) days after execution of a definitive agreement for Built Services.
You agree not to abuse any of the services provided by Built. This includes the online registration mechanism, tools in the Referral Website and any other resources provided by Built through conduct which is, or can be, interpreted to be detrimental to the brand, trademark or interests of Built, including without limitation, attempting to make referrals or receive rewards in a manner inconsistent with these Rules or the intent of these Rules, attempting to earn rewards through illegitimate channels, or any other activity deemed by Built to be abusive.
Advocacy Program Registration can occur at getbuilt.nextbeeapp.com(the "Referral Website").
Upon completion of registration for the Advocacy Website, you will have the option to make referrals via email. You may also make referrals by submitting contacts to Built via the referral form.
You will receive the Reward in the form of a gift card issued in U.S. Dollars. Rewards are subject to local, state and federal taxes.Built encourages the keeping of all statements and documents for record keeping purposes.
By participating in the Referral Program, you agree to release, discharge, indemnify, and hold harmless Built from any and all liability arising from your participation in the Referral Program. This includes your agreement to release, discharge, indemnify, and hold harmless all parent, subsidiaries, affiliates, retailers, and advertising and promotion agencies, and all of their respective officers, directors, shareholders, employees and agents (collectively, "Released Parties") from any liability or damages which may arise out of participation in the Referral Program or out of the acceptance, use, misuse or possession of any Reward or products attained through this Referral Program. You further agree not to: (a) bind, create any obligation (express or implied) or negotiate prices or other terms and conditions on Built’s behalf (nor represent to any person, including any prospective Built customer or New Eligible Customer, that you have authority to do so); or (b) make any claims regarding the Built Services beyond those made by Built Services on its website unless it is an opinion based on your use of Built’s Services. Moreover, you also agree that any promotion methods that you use to promote Built Services to prospective Built customers shall be in accordance with all applicable laws and regulations. All applicable federal, state, and local laws and regulations apply.
Built reserves the right to disqualify and deregister any Referrer in the event that Built determines that Referrer has violated any of these Rules, which determination shall be final. In the event of such disqualification or deregistration, Referrer forfeits the rights to receive, and Built is not obligated to honor or pay any Rewards which vest on or after the date of such effective disqualification or deregistration.
Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of the participant and Built in connection with the Referral Program, shall be governed by, and construed in accordance with, the laws of the State of Delaware without giving effect to any choice of law or conflict of law rules (whether of the State of Delaware, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Delaware.
As a condition of entering the Program, and unless prohibited by law, Referrers agree that under no circumstances will Referrers be entitled to any awards for any losses or damages, and Referrers hereby waive all rights to claim punitive, incidental, consequential and any other damages, and waives any and all rights to have damages multiplied or otherwise increased. A waiver of rights may not apply to you in your jurisdiction of residence. Additional rights may be available to you.
